1. Introduction
1.1. These terms and conditions ("Terms") govern the provision of film and photography services by Chris Smart Films, a sole trader.
1.2. By engaging our services, you agree to be bound by these Terms. Please read them carefully and contact us if you have any questions.
2. Services
2.1. We agree to provide film and photography services as described in the agreed-upon scope of work.
2.2. Any additional services you request will be subject to a separate agreement and may incur additional fees.
3. Payment Terms
3.1. Payment for our services is due as within 30 days of invoice
3.2. Late payments may be subject to a 10% late fee.
3.3. All prices are inclusive of applicable taxes unless otherwise stated.
4. Cancellation and Rescheduling
4.1. Cancellation by you:
4.1.1. Cancellations made 7 or more before the scheduled date will incur no cancellation fee.
4.1.2. Cancellations made within 7 of the scheduled date may result in a 25% cancellation fee.
4.2. Cancellation by us:
4.2.1. We reserve the right to cancel or reschedule services due to unforeseen circumstances. In such cases, we will make reasonable efforts to reschedule or provide a refund.
5. Intellectual Property
5.1. All intellectual property rights, including copyrights, in the final delivered film and photographs are retained by Chris Smart Films.
5.2. You are granted a non-exclusive license to use the final deliverables for personal, commercial and non-commercial purposes.
6. Client Responsibilities
6.1. You agree to cooperate with us to ensure the successful completion of the project, including providing necessary information, access, and approvals.
6.2. Unless agreed, you are responsible for obtaining any necessary permissions or clearances for locations, individuals, or copyrighted materials that may be included in the project.
7. Confidentiality
7.1. Both parties agree to keep confidential any information shared during the course of the project.
8. Liability
8.1. We shall not be liable for any loss, damage, or injury arising from our services, except in cases of willful misconduct or gross negligence.
9. Governing Law
9.1. These Terms shall be governed by and construed in accordance with the laws of the UK
10. Changes to Terms
10.1. We reserve the right to update or modify these Terms at any time. Any changes will be effective upon posting on our website.
